How Do I Report Copyright Infringement?

Notice and Procedure for Making Claims of Copyright Infringement

MIKZOL Kft. (d/b/a CLASSITE) stores and publishes information on publicly available audio items on classite.com, under the fair use regulations. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide classite.com's agent with the following written information as specified below, at the address shown. Please note that this procedure is exclusively for notifying us that your copyrighted material has been infringed. We also recommend that you notify the alleged infringer directly.

Please carefully consider your claim prior to submitting it. Submitting false claims through this process may result in CLASSITE taking actions against your account, including, but not limited to, account suspension or termination. In addition, false statements in your notice may lead to civil or criminal penalties.

Required Materials and Information:

  • The designation and exact description of the copyrighted work that you claim has been infringed upon
  • A description of where the material that you claim is infringing is located on the site
  • Your name, address, telephone number, and e-mail address
  • A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or it is prohibited by legislation
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
  • If you are acting as an authorised agent, a certificate to the effect that the copyright owner has authorised you to act on their behalf

Submitting a Counterclaim

If your listing was reported and you believe your listing was removed in error, then we recommend that you contact the rights owner directly. If the rights owner has made a mistake, then they can contact us directly to retract their original notice.

You may also file a counter-notice by sending the following information to us. Please carefully consider your claim prior to submitting a counter-notice. Submitting false claims through this process may result in CLASSITE taking actions against your account, including, but not limited to, account suspension or termination. In addition, false statements in your written counter-notice may lead to civil or criminal penalties.

Required Materials and Information:

  • The designation and exact description of the material that has been removed
  • A description of where the material is located on the site
  • A statement by you, made under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification of the material to be removed
  • Your name, address, telephone number, and e-mail address
  • A statement that you consent to the jurisdiction of the Hungarian court of low with jurisdiction over your residential address or company seat (if your residential address or company seat is outside Hungary, you must declare that you consent to the jurisdiction of the Hungarian court with jurisdiction over our company seat)

Once we receive a counter-notice containing all of the above required items, we'll provide a copy of the notice to the complainant to inform them that the listings will be reinstated after 10 business days if they don't inform us that they have filed an action seeking a court order to restrain you from relisting the items.

In the case of both copyright infringement claims and counterclaims, we reserve the right to request the reporting party to present additional documents or the originals of certain documents (e.g. authorisation) to support the claim in order to assess whether the claim in question is well-founded.
